Overview

What this deed actually does

A gift deed is the legal instrument that transfers ownership of movable or immovable property from the donor to the donee without consideration.
For immovable property, the deed must be registered with the sub-registrar to be valid — an unregistered gift of property doesn't transfer title.
Stamp duty applies as per the state schedule; several states offer concessional rates for gifts to close relatives.
Gifts to specified relatives are generally exempt from income tax in the donee's hands; other gifts above the threshold can be taxable.
The deed must record voluntary transfer, acceptance by the donee, and clear identification of the property.

Benefits

Why families get this done through us

Open each benefit to see what it means for you.

Title that actually transfers

We ensure drafting, stamp duty, and registration are all correct — so the donee's ownership is beyond question.

Stamp duty optimised legally

We apply the correct state schedule and relative-based concessions, so you pay what's due — not more.

Tax position clarified

We explain the income tax and capital gains implications for both donor and donee before the deed is signed.

Future disputes prevented

Clear recitals of voluntariness and acceptance shut down the most common grounds for challenging gifts.

Documents

What we need from you

Clear, current documents matter more than a long checklist. Names, dates of birth and addresses should match across records.

Process

How we handle your gift deed

You’ll see each stage, what’s pending and what we need from you — so filings don’t bounce back.

Step 1 of 5

Verify title and relationship

We check the property title is clear and confirm the donor-donee relationship for duty concessions.

Draft the deed

The gift deed is drafted with voluntary-transfer recitals, acceptance clause, and precise property description.

Compute stamp duty

Duty is computed under the state schedule with applicable relative concessions.

Register the deed

We coordinate execution and registration at the sub-registrar's office.

Complete the transfer

Post-registration, we guide the mutation and record updates so the donee is recognised as owner everywhere.

If a founder or investor is outside India

Foreign ownership is possible in many sectors, but it adds document authentication, banking and FEMA work. Set the route before funds move.

Plan before you start

  • Check whether your sector permits automatic-route foreign investment
  • Confirm the Indian resident director arrangement
  • Map ownership, beneficial ownership and pricing
  • Allow time for apostilled or consularised documents

Plan for after setup

  • Receive funds through permitted banking channels
  • Complete RBI/FEMA reporting and keep the bank evidence
  • Coordinate tax and ongoing compliance advice early

For immovable property, yes — registration is required for the transfer to be legally valid. For movable property, delivery with a written deed generally suffices.
It varies by state and by relationship — many states charge concessional rates for gifts between close relatives. We compute the exact duty for your case.
Gifts from specified relatives (parents, siblings, spouse, etc.) are exempt. Gifts from others above the annual threshold are taxable as income. We confirm your position.
Generally no, once accepted and registered — revocation is possible only in narrow circumstances like fraud or undue influence. That's why proper drafting matters.
It's complicated — the lender's consent is typically needed, and the liability question must be addressed in the deed. Talk to us before proceeding.
Typically 2–4 weeks from clear title to registered deed, depending on registration slot availability.
A gift deed transfers ownership immediately; a will takes effect after death. Gifts are irrevocable once completed; wills can be changed anytime.
