Procedure for Filing Petition

Filing Petition
The aggrieved party files a Restitution of Conjugal Rights Petition in the district court. This petition can be transferred to the High Court or the Supreme Court.

Hearing
Copy of the petition is sent to the respondent with a hearing date received from the district court. The court requires both the parties to be present on the hearing date in front of the Hon’ble Judge

Counselling
Court send the parties for the counselling, the court counselling is done by the family courts and usually goes for 3 to 4 times with an interval of 20 days between the session

Decree
Based on the counselling and keeping in view the conduct of the parties the court may finally grants the decree. If the decree is not followed within 1 year then this can be the ground for divorce
