Process of Revival of the Company

Preparation of Appeal
The first step of revival of Company is to prepare an appeal with Hon’ble NCLT Bench in NCLT-9 and file with a competent professional.

Notice to Registrar
Upon the application filed with NCLT, a copy of appeal is also served on ROC & Income Tax Department for their report.

Hearing by Tribunal
The Tribunal will take note of the report received. Once the hearing is convened, the restoration of name of company can be ordered for revival of Company.

Filing of order with ROC
The Company shall file the copy of Order in Form INC-28 with the ROC within 30 days from the date of the order.

Filing the Annual Return with MCA
Upon the Revival of Companies, the company shall file pending Financial Statements and Annual Returns with the Registrar.

Restoration of Name
The Registrar of Companies publish the order in the Official Gazette in his official name, after restoration of the name of the Company in his records.
