What is Patent registration ?

Intellectual property (e.g. trademark, copyright, patent, etc.) is something, a creative expression, symbol, product, design or image-that is protected by law on account of its originality. A patent, in particular, refers to the right granted by the government to an individual or enterprise that prohibits others from making, using, selling or importing the patented products or processes without prior approval from the patent holder. Patents are granted to inventions in the form of products, methods, processes, software, technical application or even art, which have utility or are capable of industrial or domestic application.

There are different types of patents which are Utility Patents, Design Patents, & Plant Patents. The validity of Patent is 20 years during which the patented invention can be used only by the patent holder or through prior permission. After 20 years, the invention falls under public domain. Normally, a patent application is tested on the criteria like its originality, its Inventiveness, and its utility.

Advantages of Patent Registration

Legal Protection on Global Scale

It gives the owner the sole right on his invention such that any other entity is excluded from using it without their prior permission.

Intangible Asset

A patent is an intellectual property that can be sold or contracted in return for a royalty.

Improved Credibility

A patented product, process or application would attract more trust from potential users hence they would be more willing to take a risk of trying a new product or concept, compared to an unpatented invention.

  • 1

All inventions are not patentable. So the first step is to check if your invention meets the criteria for patentability.

  • 2

Patent application requires several specific information points and supporting documents related to the invention, which should be kept ready before filling the patent application form.

  • 3

Our patents experts will skillfully draft the application for you in order to ensure maximum possibility of success. Then the application will be filed with the Registrar along with the necessary documents.

  • 4

After 18 months of initial application, the application is published in a recognized journal of the relevant field. With the payment of additional fee, this period can be reduced to 15 days.

  • 5

An examiner is appointed after a request for patent examination is filed. The examination involves checking for patentability, which is followed by submission of a report by the examiner to a controller.

  • 6

The controller checks the report for any objections and if they arise, the applicant is informed about the same. The applicant needs to respond to these objections with a strong report in order to resolve them, in due time.

  • 7

Once the objections are resolved satisfactorily, the patent is granted and published in a journal.
