What is Trademark Restoration ?

A trademark is a logo or the symbol that excludes the identity of a company or brand from others and is registered so that it cannot be infringed or used by other companies. Trademark rights are generally used to help prevent others from using a similar work. Any illegal use of the trademark by any other company gives the legal right to legal action by the authorized company. Once the company is formed, it needs to register its trademark which is valid for 10 years and required revalidation after every 10 years. If the company does not apply for renewal process with renewal fees within the given period and misses out on getting the Trademark renewed, the company needs to apply for restoration of trademark and is usually done within 6 months before the expiration of the same. This is referred to as Trademark restoration. The Trademark restoration will help in the preservation of the right and all protection that comes with it. If the brand owner is failed to get the Trademark restored in his name within 6 months of the expiration of validity, the trademark is free to be registered by any other person, therefore it is suggested to restore the identity of your brand if not renewal is not done. The expired trademark can be further restored within 6 months of its expiration by filing Form TM-R to the Registrar of Trademark along with the Application fees.
