What is Trademark Registration?

Trademark is a unique expression that is exclusive to a product or service and may be a symbol, slogan, word, color combination, logo, photograph etc. Most businesses choose to register their brand or logo as a trademark. The main property of a trademark is that once registered, no other entity can copy or use it. Trademark issues in India are handled through the Trademarks Act, 1999, by the Trademarks Registry. Before registration, one needs to check the availability of the trademark for which they wish to apply.

 

The business that registers a trademark has the right to sell its products under that brand in a certain sector of the economy. There are 45 sectors in which trademarks can be registered that are officially addressed as classes.34 of them are manufacturing classes and 8 of them are into a service class. For example, Class 12 represents vehicles, so trademark for a vehicle would have to be registered under Class 12.

 

Normally, Post application, you can use the symbol TM within 3 days, but the registration process takes up to six months to one year after which the symbol ® can be used. This registration is valid for 10 years after which one needs to apply for renewal.
